RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a revenue agreement with Fresno City College, effective upon execution through June 30, 2023, not to exceed $183,750 per year.

REPORT

There is no Net County Cost associated with the recommended action, which will approve a partnership between Fresno City College (FCC) and the Probation Department, by establishing law enforcement educational courses and instruction through FCC’s Police Academy.  The proposed agreement also allows the Probation Department to receive $3.50 per student instruction hour for each student, and offsets a portion of the cost for the Probation Department’s Training Unit.  This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. The law enforcement educational courses and instruction are authorized by the California Education Code and Title 5 of the California Code of Regulations.  If this agreement is not approved, the Probation Department would not be eligible to receive revenue from FCC for training courses run through FCC.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. The recommended revenue agreement designates the FCC student instructional hourly rate at $3.50 per student. FCC receives a yearly budget to reimburse the local agencies for this service.

 

The Probation Department Training Unit is responsible for providing training for the Probation employees. The agreement allows a maximum of $183,750 per year (52,500 student instructional hours times $3.50 per instructional hour.   At this time, it is not known how many Probation training classes will be run through Fresno City College for FY 2019-20.  Due to this, the amount of revenue estimated to be received in FY 2019-20 is not known.    

 

DISCUSSION:

 

The approval of the recommended action will allow the Probation Department, through FCC, to provide law enforcement training courses through FCC’s Police Academy. The partnership is very beneficial, since FCC will provide ancillary and support services (i.e., counseling, guidance, and job placement assistance), and college credits to Police Academy students. Since the Probation Department provides instructors for the course, FCC will pay the County $3.50 for each student instructional hour. This is the same amount paid to other law enforcement agencies for the same type of services.  The Sheriff’s Department has a similar agreement with FCC.

 

The agreement with FCC differs from the County’s model contract in that it contains a mutual hold harmless clause. This has the effect of making each party responsible for losses arising from their own negligent acts. This agreement also has non-standard insurance requirements, and requires certain non-binding arbitration in case of disputes. However, staff believes that the benefits of entering into this agreement outweigh any potential risk.

 

This agreement can be terminated by either party with thirty days advance written notice. The proposed agreement with FCC will be effective upon execution through June 30, 2023.
