RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute a Consent to Common Use Agreement with Pacific Gas and Electric Company to establish a common use area for the Auberry Road and Copper Avenue Traffic Signal Installation, Federal Project Number HSIPL-5942(241), effective upon execution in perpetuity ($0); and

 

2.                     Authorize the Director of the Department of Public Works and Planning to execute, subject to the review and approval of County Counsel as to legal form and the Auditor-Controller/Treasurer-Tax Collector as to accounting form, any amendments necessary to ensure compliance with Federal Highway Administration and California Department of Transportation requirements.

REPORT

Approval of the recommended actions will allow the County and Pacific Gas and Electric Company (PG&E) to enter into an agreement that will establish an Area of Common Use for the Auberry Road and Copper Avenue Traffic Signal Installation Project (Project) and authorize the Director to sign any amendments required to ensure Federal and State compliance.  This item pertains to a location in District 5.

 

ALTERNATIVE ACTION(S):

 

Not approving the recommended actions will cancel or delay the Project.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended actions.

 

DISCUSSION:

 

The Project will install a new four-phase traffic signal with protected left-turn phasing at the intersection of Auberry Road and Copper Avenue.  On February 7, 2017, the County acquired property in the project area for right-of-way purposes, a portion of which occupies an easement owned by PG&E.  In order to complete the Project, access to the common area is necessary, requiring an agreement between the County and PG&E authorizing access while retaining all other rights to the property.

 

 

 

The Project requires that PG&E move their existing facilities in the area, and the County has a Utility Agreement to pay PG&E to do so.  The recommended Consent to Common Use Agreement does not affect the existing agreement.

 

It is anticipated that project construction will begin in September 2019 and be completed by March 2020.
