SUBJECT: Resolution to accept a monetary donation from the Estate of Wayne A. Brooks
RECOMMENDED ACTION(S):
TITLE
1. Adopt Resolution accepting and expressing gratitude for a monetary donation of $9,500 from the Estate of Wayne A. Brooks to the Fresno County Public Library for new Library facilities; and
2. Authorize the County Librarian to execute all documents required to receive distribution of trust assets, including, but not limited to, Acknowledgement of Receipt & Consent to Terms, subject to review and approval by County Counsel and the Auditor-Controller/Treasurer-Tax Collector.
REPORT
There is no Net County Cost associated with the recommended actions. The first recommended action is required to satisfy the reporting and approval requirements under Board of Supervisors Administrative Policy Number 30, for donations greater than $7,500 in value. Approval of the recommended actions will allow the Fresno County Public Library to accept the donation from the Estate of Wayne A. Brooks in the amount of $9,500 to equally support both the new Clovis and future Reedley Library capital construction projects. The impact of the donation will be in Districts Five and Four.
ALTERNATIVE ACTION(S):
Your Board may choose to not accept the donation, in which case the funds will not be available to support the development of both the new Clovis Library and the future Reedley Library capital construction projects.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended actions. The Estate of Wayne A. Brooks donation in the amount of $9,500 is intended to equally support both the new Clovis and future Reedley Library capital construction projects. The donation of $9,500 will increase the Fund Balance under restricted donations in County Library Book Fund Org 7521. Specifically, half ($4,750) of the donation is to be deposited into Org 75215350 Clovis Capital General and half ($4,750) is to be deposited into Org 75215360 Reedley Capital General. The Library will return to the Board at a later date to request sufficient appropriations to support the Clovis and Reedley Library capital construction projects
DISCUSSION:
On June 2, 2015, the Board provided direction for the Library to build a new and larger facility in the City of Clovis to replace the current branch. The current Clovis Library is 8,600 square feet. The City of Clovis acquired a parcel of vacant land at 755 Third Street, in the Old Town area of Clovis for the purposes of constructing city facilities to include a new library, senior center, transit hub and sufficient parking.
On August 25, 2015, the Board also provided direction for the Library to build a new and larger facility in the City of Reedley to replace the current branch. The current Reedley Library is 5,000 square feet and has served the community since 1973. The City of Reedley has contacted the Internal Services Department and provided notification of their intention to donate two adjacent vacant properties located at 1819 11th Street, Reedley CA 93654, to the County of Fresno for the purpose of building a new library branch. The City of Reedley is donating the properties on behalf of the Friends of the Reedley Branch Library. The Library is planning to build an 11,000 square foot building that will include a children’s room, teen space, meeting room, study areas, quiet room, and an innovation hub where people can choose to be creative.
The Library received the donation check in the amount of $9,500 from the Estate of Wayne A. Brooks with the intent that it be used to support equally the building of both the new Clovis ($4,750) and the future Reedley ($4,750) Library facilities. It should be noted the Library’s Facilities Master Plan is also on today’s Board date. Wayne A. Brooks, the decedent, under the terms of his will, provided for a gift to the Fresno County Public Library in the amount of approximately $9,500. The second recommended action allows the Librarian to sign the required Acknowledgement of Receipt form subject to review and approval by County Counsel and the Auditor-Controller/Treasure-Tax Collector. Upon your Board’s approval of the recommended action, the Library will accept the donation.
DONOR DISCLOSURES:
To satisfy reporting requirements under Administrative Policy 30 for donations greater than $7,500 in value, the following is provided in addition to the information provided above:
• The Estate of Wayne A. Brooks is not a County contractor or principal in a business, agency, or organization providing contracted services within the County.
• The Estate of Wayne A. Brooks is not a contractor that has bid on a County contract in the last 12 months.
• The Fresno County Public Library has no knowledge that the donor will bid on any County contract within the next twelve months.
• The Estate of Wayne A. Brooks has provided a monetary donation of $9,500, of which half ($4,750) is to be deposited into Org 75215350 Clovis Capital General, Account 5890 Donations, and half ($4,750) is to be deposited into Org 75215360 Reedley Capital General, Account 5890 Donations.
