RECOMMENDED ACTION(S):

TITLE

Approve and authorize Chairman to execute the First Amendment to Agreement No. 18-117 with the Fresno Economic Opportunities Commission for a construction apprenticeship program for adult offenders, to allow adjustments to the Agreement’s line item budget up to 10% of the annual maximum compensation, as long as the changes do not result in a change in the total annual not to exceed amount, with approval of the Chief Probation Officer, effective upon execution with no change in term to April 30, 2023.

REPORT

There is no increase in Net County Cost associated with the recommended action, as there are no additional costs for this amendment. The Agreement engaged Fresno Economic Opportunities Commission (Fresno EOC) to provide a construction apprenticeship program for adult offenders through its Valley Apprenticeship Connections (VAC) program, which was developed using input from various trade unions and evidence-based material, with the aim of preparing and placing participants in various construction industry jobs. Approval of the recommended action will allow for adjustments to the Agreement’s line item budget of up to 10% of the annual maximum compensation, upon approval of the Chief Probation Officer. These proposed changes will help Fresno EOC better achieve the goals of the program, such as increasing attendance and increasing job opportunities for graduates.  This item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, there will be no changes to Agreement No. 18-117.

 

FISCAL IMPACT:

 

There is no additional Net County Cost associated with the recommended action. There is no increase in funding resulting from the recommended amendment. The maximum annual compensation for this agreement will remain at $264,000, with a maximum compensation for the full term (5 years) totaling $1,320,000. Appropriations and estimated revenues are included in Probation’s FY 2019-20 Recommended Budget for Org 3430, which will be presented to your Board in September 2019. Funding for future years of this agreement will be included in subsequent budget requests.  This Agreement is fully funded with Public Safety Realignment Act of 2011 AB 109 funds.

 

DISCUSSION:

 

On March 20, 2018, the Board of Supervisors approved a five-year Agreement with Fresno EOC to provide a construction apprenticeship program for adult offenders through their VAC program. VAC is a 12-week construction apprenticeship program for adult offenders that was developed using input from various trade unions and evidence-based material, with the aim of preparing and placing participants in various construction industry jobs. Individuals in the program take part in physical education, Thinking for a Change, educational tutoring, and financial literacy courses to ensure they are prepared to join the workforce. In addition to the courses, participants are required to have two random drug tests, acquire various industry certifications, and attend union trade meet and greets.

 

Fresno EOC is requesting changes to the line item budget for the VAC program in order to better achieve the goals of the program, such as increasing attendance and increasing job opportunities for graduates. Since the line item budget is part of the Agreement, any changes to the line budget would require your Board’s approval.  The recommended amendment would allow adjustments to the line item budget of up to 10% of the annual maximum compensation, with the approval of the Chief Probation Officer.  The annual maximum compensation for the Agreement would not change as a result of this amendment.  This language has been included in other service agreements approved by your Board.  On June 10, 2019, the Community Corrections Partnership Executive Committee recommended your Board approve this amendment to the Agreement.
