RECOMMENDED ACTION(S):

TITLE

1.                     Retroactively authorize the District Attorney’s previous submittal of a grant application to the California Office of Traffic Safety for continuation of the Alcohol and Drug Impaired Driver Vertical Prosecution Program for FY 2019-20 ($729,282); and

2.                     Approve and authorize the Chairman to execute Agreement for the Alcohol and Drug Impaired Vertical Prosecution Program with the California Office of Traffic Safety (OTS) for the period October 1, 2019 through September 30, 2020 ($253,070).

REPORT

There is no increase in Net County Cost associated with the recommended actions, which will allow for the continuation of the Alcohol and Drug Impaired Driver Vertical Prosecution program (ADVIPP) through September 30, 2020. The ADVIPP grant program will fund one Deputy District Attorney to handle cases throughout each step of the criminal process, work to increase the capabilities of the program by obtaining and delivering specialized training, and share information with peers and law enforcement personnel throughout the County and across the State. To meet the grant filing deadline, the application was submitted to the OTS, contingent on your Board’s approval. This item is countywide.

ALTERNATIVE ACTION(S):

If the recommended actions are not approved, this program will not be funded for FY 2019-20, which would result in the elimination of one Deputy District Attorney position.

FISCAL IMPACT:

There is no increase in Net County Cost associated with these actions.  There is no match requirement for the receipt of the funds.  The Department submitted a grant application in the amount of $729,282.  The OTS awarded $253,070 to Fresno County for the FY 2019-20 Alcohol and Drug Impaired Vertical Prosecution Program, which funds most of a Deputy District Attorney position.  The total cost of the program for FY 2019-20 is $259,706.  Of this amount $253,070 is grant funded, while $6,636 is Net County Cost, which is included in the FY 2019-20 District Attorney Grants Org 28622500 Recommended Budget.  Sufficient appropriations will also be included in the Department’s future budget requests.

DISCUSSION:

The goal of the ADVIPP is to investigate and vertically prosecute felony alcohol and drug-impaired driving cases. The ADVIPP grant program will fund one Deputy District Attorney to handle cases throughout each step of the criminal process, and work to increase the capabilities of the program by obtaining and delivering specialized training.  The ADVIPP program attorney will also share information with peers and law enforcement personnel throughout the County and across the State.  The ADVIPP program will accomplish these objectives as a means to prevent impaired driving, and reduce alcohol and drug-involved traffic fatalities and injuries.

If grant funding is eliminated, the Deputy District Attorney position will be deleted.
