RECOMMENDED ACTION(S):

TITLE

Approve and authorize Chairman to execute Amendment I to Agreement No. 18-561 with the City of Kerman for the Kerman Stanislaus Avenue Park Development, Community Development Block Grant Project No. 17371, effective upon execution, with no change in the term and increasing the maximum by $142,404 to $592,404.

REPORT

Approval of the recommended action will provide an additional $146,752 in Community Development Block Grant (CDBG) funds to the Kerman Stanislaus Avenue Park Development Project (Project), which will increase the Project’s CDBG funds from $419,292 to $566,044. The additional funds are needed due to increased construction costs related to the added park amenities proposed by the City of Kerman (City).  The additional CDBG funds are available from the City’s CDBG allocation included in the County’s 2019-20 Action Plan, and approved by your Board on June 4, 2019.  The Project cost is now estimated at $592,404. The City reduced its local financial contribution to complete the Project from $30,708 to $26,360. This item pertains to a location in District 4.

ALTERNATIVE ACTION(S):

If this amendment is not approved, the City may not have sufficient funds to complete the entire project.

FISCAL IMPACT:

There is no Net County Cost associated with the recommended action.  The total estimated Project cost is now $592,404. The proposed amendment will increase CDBG funding for the Project from the City's CDBG allocation by $146,752, from $419,292, to $566,044.  The additional CDBG funds are included in the Department of Public Works and Planning - Community Development Block Grant Org 7205 FY 2019-20 Adopted Budget.  The County provides CDBG funds on a reimbursement basis.  The City’s local financial contribution in excess of the CDBG funds was reduced from $30,708 to $26,360, which may be necessary to complete the Project.

DISCUSSION:

On September 25, 2018, the Board approved the Project, then estimated at $450,000.  The agreement provided CDBG funds ($419,292) to the City, on a reimbursement basis, for the development of the Stanislaus Avenue Park (APN 023-350-19ST), located on the south side of Stanislaus Avenue, approximately 700 feet east of its intersection with S. Goldenrod Avenue in the City.

The Project cost increased due to additional park amenities proposed by the City.  The recommended amendment will increase the total CDBG funds allocated to the Project from $419,292 to $566,044, which is necessary to offset increases in construction costs for those amenities.  The City reduced its committed funding from $30,708 to $26,360 in local funds to complete the Project.  All remaining provisions of the agreement will remain in full force and effect.
