SUBJECT:                     Retroactive Agreement with the City of Clovis to participate on the Public Safety Realignment Act Adult Compliance Team

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute retroactive Agreement with the City of Clovis, effective July 1, 2019 through June 30, 2020, with a total of $674,400;

2.                     Adopt Budget Resolution increasing the FY 2019-20 appropriations in the Local Community Corrections Org 3436 in the amount of $152,400 (4/5 vote); and

3.                     Adopt Budget Resolution increasing the FY 2019-20 appropriations and estimated revenues in Probation Org 3430 in the amount of $152,400 (4/5 vote);

REPORT

There is no Net County Cost associated with the recommended actions, as Public Safety Realignment Act (Assembly Bill 109) funds will be utilized to fund this Agreement.  The recommended actions authorize execution of a new retroactive agreement with the City of Clovis to continue to provide two existing sworn Police Officers and one new Crime Specialist position to participate as members of the Public Safety Realignment Act (Assembly Bill 109) Adult Compliance Team (ACT), as authorized by the approved Community Corrections Partnership (CCP) Plan. The recommended agreement is retroactive to July 1, 2019, the date that prior Agreement No. 18-630 expired, and incorporates all terms of Agreement No. 18-630. The recommended agreement includes $8,000 in funding for FY 2018-2019, for services performed by the City of Clovis during that time period. The recommended agreement also includes an ACT training allocation that was approved by the CCP within the Sheriff Department’s Org 3111 Budget. The recommended budget resolutions will provide the necessary appropriations and estimated revenue for the new Specialist position for FY 2019-20.  Although the recommended agreement is with the City of Clovis, which is in District Five, this item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the recommended actions are not approved, the ACT would not include two Police Officers and a Crime Specialist from the City of Clovis, and the County would need to identify an alternative method of paying for ACT trainings.

 

RETROACTIVE AGREEMENT:

 

The recommended agreement is retroactive, due to the need to adjust the City of Clovis’ FY 2018-19 ACT training allocation, which was approved by the CCP, to allow for reimbursement for ACT trainings. All future recommended agreements or amendments for the City of Clovis for ACT will include a training allocation consistent with the budget that is approved by the CCP.  In addition, the agreement is retroactive due to the length of time required to prepare the agreement and have it reviewed and approved by the City of Clovis.  The recommended agreement was signed by the City of Clovis on October 4, 2019, and received by the Probation Department on October 4, 2019.  

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended actions. The recommended actions will provide funding for the agreement with the City of Clovis in the amount of $674,400, to provide for two existing sworn Police Officers including supplies and vehicles ($439,000) and a new Crime Specialist ($152,400) for FY 2019-20, ACT Training for FY 2019-20 ($75,000), and ACT training for FY 2018-19 ($8,000).  The recommended agreement is fully funded with AB 109 revenue.  The recommended budget resolutions will provide the necessary appropriations and estimated revenue for the new Crime Specialist. Appropriations and estimated revenues have been included in the FY 2019-20 Adopted Budgets for Org 3430 - Probation and Org 3111 - Sheriff for the remaining costs associated with the recommended agreement.  There are no pending invoices.

 

DISCUSSION:

 

On November 6, 2018, your Board approved agreement No. 18-630 with the City of Clovis for the continuation of two sworn Police Officers to participate as members of the AB 109 Adult Compliance Team (ACT), as authorized by the approved CCP.

 

As approved by the CCP, the ACT is currently comprised of sworn officers from the Fresno County Sheriff’s Office, the Fresno Police Department which also includes a Crime Analyst, the Clovis Police Department, the Selma Police Department, the Reedley Police Department, the Kerman Police Department, the Kingsburg Police Department, the Fresno County Probation Department, and two Investigators from the Fresno County District Attorney’s Office. The purpose of the ACT is to add an additional layer of offender supervision and public safety by working as a cooperative unit capable of addressing public safety concerns and issues facing local law enforcement of Fresno County. The ACT enforces conditions of probation, conducts compliance and non-compliance searches of AB 109 probationers who are under the supervision of the Fresno County Probation Department, and provides immediate response to crisis situations. In addition, ACT can provide surveillance and warrant sweeps in conjunction with other law enforcement agencies.

 

On September 9, 2019, the CCP approved the addition of a Clovis Crime Specialist to the ACT. The primary duties of the Crime Specialist are to track and report criminal activities for the ACT operational duties, and specifically, prepare documentation and reports related to crime series, trends, and patterns to increase the effectiveness and efficiency in the deployment of resources and apprehension of suspects.

 

The Chief of Police for the City of Clovis is responsible for payment of the trainings for the ACT Officers, as approved by the Sheriff’s Sergeant assigned to the ACT.  The City of Clovis is reimbursed for these expenses by the Sheriff’s Office through its AB 109 allocation. The recommended retroactive agreement will provide AB 109 funding for two existing Clovis Police Officers and one new Crime Specialist assigned to the ACT, and ACT training costs for FY 2019-20.  In addition, the recommended agreement will provide a total of funds for $8,000 in 2018-19 training costs that were incorrectly paid out of the FY 2017-18 City of Clovis Act Agreement, for which the City of Clovis performed services.

 

The recommended agreement incorporates all terms of Agreement No. 18-630, and ratifies any services that were performed by the City of Clovis in the period of time since Agreement No. 18-630 expired.
