SUBJECT: Authorize Development of Agreements
RECOMMENDED ACTION(S):
TITLE
Authorize the County Administrative Officer to develop two agreements, one with the City of Fresno and one with the State of California, Department of Transportation for the receipt of an administrative fee for the use of the Adult Offender Work Program.
REPORT
There is no increase in Net County Cost associated with the recommended action. The agreements are for the receipt of an administrative fee for the Workers Compensation provision for participants in the Adult Offender Work Program (AOWP). The Workers Compensation is $20,000 per entity per year for three years. The $60,000 in annual funding will offset Probation’s cost for the Workers Compensation provision and will be divided evenly between the City of Fresno, CALTRANS, and Supervisor District Two’s budget. The AOWP participants will provide clean-up services on roadways located in the City of Fresno. This item is countywide.
ALTERNATIVE ACTION(S):
If your Board does not approve the recommended action, staff will not move forward to develop the agreements and the City of Fresno and CALTRANS will not utilize the AOWP for clean-up services.
FISCAL IMPACT:
There is no additional Net County Cost associated with the recommended action. Sufficient appropriations are included in the Board of Supervisors Org 0110 - District Two’s FY 2019-20 Adopted Budget to cover the County’s share for the Workers Compensation provision.
DISCUSSION:
The County of Fresno had an agreement with CALTRANS since 2005 to allow participants from the AOWP to perform roadside work for CALTRANS. The last agreement with CALTRANS for these services expired on October 31, 2018 and was not renewed. As part of that agreement, the County assumed the Workers Compensation Risk provision of insurance for this Program; however, the County experienced a large claim and was no longer able to assume this coverage and therefore the agreement was not renewed after it expired on October 31, 2018.
Staff costs associated with the Program are funded with fees that are charged to the participants in the AOWP. The administrative fee of $60,000 per year is for the Workers Compensation provision and will be split three ways as follows: $20,000 City of Fresno, $20,000 CALTRANS, and $20,000 from District Two’s budget in accordance with Administrative Policy 75. The proposed agreements will be for a three-year period.
The purpose of this item is for your Board to authorize the CAO to develop two agreements, one with the City of Fresno and one with CALTRANS to provide funding for the Workers Compensation provision and allow the City of Fresno and CALTRANS to utilize participants in the AOWP for clean-up services on roadways in the City of Fresno.
It should be noted other entities that utilize the participants of the AOWP pay for the Workers Compensation provision. Probation’s agreement with CALTRANS was the only one in which the County assumed the Risk for this Program.
