SUBJECT:                     Retroactive Agreement with Central Unified School District for Law Enforcement                      Services

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive Agreement with the Central Unified School District for law enforcement services, effective August 14, 2019, not to exceed five consecutive years, which includes a three-year base contract and two optional one-year extensions, total not to exceed $935,870.

REPORT

Approval of the recommended action will allow the Department to provide law enforcement services to the Central Unified School District with the assignment of one Deputy Sheriff position during the school year to Central High School West Campus. The recommended agreement is offset with revenue from Central Unified and Net County Cost, if needed, based on the Master Schedule of Fees approved at the time.  This item pertains to a location in District 3.

 

ALTERNATIVE ACTION(S):

 

If your Board does not approve the recommended action, the Sheriff’s Office would be required to discontinue providing services to the Central Unified School District due to loss of funding and the subsequent elimination of one Deputy Sheriff position.

 

RETROACTIVE AGREEMENT:

 

This recommended agreement is retroactive due to Master Schedule of Fees (MSF) rates being approved and adopted by your Board on October 22, 2019, after the school year started for Central Unified School District and the length of time required for negotiation and approval of the agreement. The signed agreement was received from the Central Unified School District on January, 23, 2020.

 

FISCAL IMPACT:

 

There is no additional Net County Cost associated with this action. The recommended agreement will provide $153,302 in revenue for FY 2019-20 from the Central Unified School District for services provided by one Deputy Sheriff for up to 1,440 hours at the fiscal year adopted MSF.  This revenue agreement will be for five consecutive years, which may increase an estimated 10% each fiscal year beginning FY 2020-21 as follows:

In addition, the recommended agreement allows for Special Events services at the request of the Central Unified School District at the overtime hourly rate of a Deputy Sheriff III.

 

On October 8, 2019, your Board approved the first hearing of the MSF rates as recommended with the exception that the fee amount for Deputy Sheriff III remain at the FY 2018-19 rates for regular and overtime. On October 22, 2019, your Board approved the amendment to the MSF rates as recommended during the first hearing.

 

The Net County Cost associated with this agreement is $13,622 for FY 2019-20. The difference represents FY 2019-20 actual costs based on the MSF rates for one Deputy Sheriff ($166,924) that were not approved by your Board and the estimated revenue from Central Unified ($153,302) based on the MSF rate approved by your Board, as noted earlier. The Sheriff-Coroner-Public Administrator’s FY 2019-20 Adopted Budget for Org 3111 contains sufficient appropriations and estimated revenues to cover the costs associated with this agreement for the current year. Sufficient appropriations and estimated revenues will also be included in future budget requests.

 

DISCUSSION:

 

The Sheriff’s Office has provided contracted law enforcement services to the Central Unified School District since 2004. Duties performed include intervention, prevention, education, and enforcement activities at the Central High School West Campus.

 

On March 12, 2019, your Board approved Agreement #19-109 to provide law enforcement services to the Central Unified School District with the assignment of one Deputy Sheriff position during the school year effective from August 15, 2018 through June 30, 2019 ($153,302). The recommended agreement continues these services for up to five years.  Additionally, at the request of the school and upon agreement of both parties, the Sheriff shall provide law enforcement services at the school’s special events at the Deputy Sheriff overtime rate of $60.43 per hour.

 

This agreement requires mutual indemnification and requires the County to comply with certain insurance provisions, such as carrying certain levels of Commercial General Liability, Automobile Liability, Professional Liability, Worker’s Compensation, and Molestation coverages. The agreement also contains additional requirements relating to insurance. The foregoing requirements are similar to the requirements the County places on contractors providing services to the County. The Sheriff’s Office has confirmed with Risk Management that the insurance requirements are acceptable in the agreement. Furthermore, the Sheriff’s Office feels that the insurance requirements are appropriate given that the County is the service provider.
