SUBJECT:                     Retroactive Agreement with City of San Joaquin for Law Enforcement

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive Agreement with the City of San Joaquin for law enforcement services, effective July 1, 2019, not to exceed five consecutive years, which includes a three-year base contract and two optional one-year extensions, total not to exceed $575,469.

REPORT

Approval of the recommended action will allow the Sheriff’s Office to continue providing an additional thirty hours per week of patrol services and coverage of events such as football games, festivals or other activities for the City of San Joaquin. This item pertains to a location in District One.

 

ALTERNATIVE ACTION(S):

 

If your Board does not approve the recommended action, the Sheriff’s Office will have a loss in revenue and a reduction in services to the City of San Joaquin.

 

RETROACTIVE AGREEMENT:

 

This recommended agreement is retroactive due to Master Schedule of Fees (MSF) rates being approved and adopted by your Board on October 22, 2019 and the length of time required for negotiation and approval of the agreement. The signed agreement was received from the City of San Joaquin on March 6, 2020.

 

FISCAL IMPACT:

 

There is no additional Net County Cost associated with this action. The recommended agreement will provide up to $94,271 in revenue for FY 2019-20 from the City of San Joaquin for overtime provided by a Deputy Sheriff for up to 1,560 hours at the fiscal year adopted MSF for each year. This revenue agreement will be for five consecutive years, which may increase an estimated 10% each fiscal year beginning FY 2020-21 as follows:

On October 8, 2019, your Board approved the first hearing of the MSF rates as recommended with the exception that the fee amount for Deputy Sheriff III remain at the FY 2018-19 rates for regular and overtime. On October 22, 2019, your Board approved the amendment to the MSF rates as recommended during the first hearing.

 

The Net County Cost associated with this agreement is $10,452 for FY 2019-20. The difference represents FY 2019-20 actual costs based on the MSF rates for one Deputy Sheriff ($104,723) that were not approved by your Board and the estimated revenue from the City of San Joaquin ($94,271) based on the MSF rates approved by your Board, as noted earlier. The Sheriff-Coroner-Public Administrator’s FY 2019-20 Adopted Budget Org 3111 contains sufficient appropriations and estimated revenues to cover these costs.  Sufficient appropriations and estimated revenues will also be included in future budget requests.

 

DISCUSSION:

 

Since 1988, the City of San Joaquin has contracted for law enforcement services with the Fresno County Sheriff’s Office. While no position is assigned to the City of San Joaquin, the City has agreed to pay the Sheriff’s Office a flat rate every month for overtime shifts to be worked in the area. The overtime shifts will be assigned at the discretion of the Sheriff, to help promote public safety.

 

On January 29, 2019, your Board approved Agreement #19-022 to continue law enforcement services to the City of San Joaquin using overtime from July 1, 2018 through June 30, 2019. Approval of the recommended action will provide continued law enforcement services to the City of San Joaquin for the three-year base contract and two optional one-year extensions through various overtime shifts.
