SUBJECT:                     Amendment II to Agreement with California Forensic Medical Group

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Amendment II to Agreement No. A-18-169 with California Forensic Medical Group effective August 5, 2020 for additional medical services for jail inmates due to the COVID-19 pandemic with no change to the term of July 1, 2018 through June 30, 2023, and increasing the maximum by $3,256,970 to a total of $124,366,023.

REPORT

There is no increase in Net County Cost associated with the recommended action as Coronavirus Aid, Relief, and Economic Security (CARES) Act funds will be utilized to cover the costs associated with the recommended amendment. Due to the COVID-19 pandemic and the ongoing spread of COVID-19 in the Fresno County Jail facilities, the County is in need of additional medical staffing to provide COVID-19 testing services, reporting and investigation, as well as COVID-19 patient care for inmates. A Purchase Order (PO) was issued to California Forensic Medical Group, Inc. (CFMG) to expedite the acquisition of the additional staffing until an agreement could be presented to your Board. Approval of the recommended action will allow CFMG, the current contracted provider of medical and behavioral health care services for inmates, to continue utilizing 50 additional temporary positions to provide additional COVID-19 services. This temporary staffing increase is scheduled to end on December 30, 2020 as the CARES Act currently provides that all claimable costs must be incurred by December 30, 2020. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. If the recommended action is not approved, the Sheriff’s Office will not be able to provide additional medical services to address the need for COVID-19 testing and treatment(s) for jail inmates.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action as costs for the temporary staffing increase will be covered with funding from CARES Act monies. Approval of the recommended amendment will increase the agreement maximum by $3,256,970 to a total of $124,366,023.

 

It should be noted that costs for the additional temporary staffing from July 16, 2020 to December 30, 2020 total $3,719,108. This total includes $462,138 for the PO and $3,256,970 for the proposed amendment.

 

Sufficient appropriations and estimated revenues for the PO and the recommended amendment will be included in the FY 2020-21 Recommended Budget for Sheriff-Coroner-Public Administrator’s Org 3111, which will be presented to your Board in September 2020.

 

DISCUSSION:

 

On April 3, 2018, the Board approved Agreement No. A-18-169 with CFMG to provide medical and behavioral health care services to the adult incarcerated individuals detained in the County Sheriff Adult Detention Facilities identified as North Annex, Main and South Annex Jails (Jail).

 

On April 28, 2020, the Board approved Amendment I to Agreement No. A-18-169 with CFMG to allow the Sheriff’s Office to approve pre-payments and accept a 1% discount for the months of May, June, July and August of 2020.

 

The unanticipated need for additional temporary medical staffing at the Fresno County Jail is due to the COVID-19 pandemic and the ongoing spread of COVID-19 in the Jail.

 

On July 16, 2020 the County Administrative Officer, under the authority granted by Resolution No. 20-093, approved a Purchase Order (PO) in the amount of $462,138 that was issued to CFMG to expedite the acquisition of the additional staffing until an agreement could be presented to your Board. The PO covered the period from July 16, 2020 to August 4, 2020.

 

Approval of the recommended action will allow the Sheriff’s Office current medical provider to continue the additional temporary staffing to provide services to accommodate for inmate care during the COVID pandemic. These services will be provided through the recommended agreement beginning August 5, 2020 to December 30, 2020 as the CARES Act currently provides that all claimable costs must be incurred by December 30, 2020. Should the need for these services continue beyond this date, options will be evaluated and presented to your Board in the future.
