SUBJECT:                     Amendment Two to Agreement with Hanson Bridgett LLP

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Amendment Two to Purchasing Agreement No. P-18-263-O (Agreement No. 19-087) with Hanson Bridgett LLP, to extend the term of the existing Agreement for specialized legal services by one year from December 31, 2020 to December 31, 2021 with no change to the compensation maximum of $250,000.

REPORT

Approval of the recommended action will allow County Counsel to continue to work with the Hanson Bridgett law firm to obtain expert legal advice as it pertains to the County’s review of access to facilities and programs and services and compliance with the Americans with Disabilities Act (ADA).  This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the recommended action, the County will not have a Board agreement with outside Counsel for expert legal advice as it pertains to the review of access to facilities and programs and services.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action.  Costs are estimated not to exceed $250,000 for the term of this agreement.  Sufficient appropriations and estimated revenues are included within the Interest and Miscellaneous Expenditures Org 2540 FY 2020-21 Adopted Budget and will be included in the FY 2021-22 budget request.

 

DISCUSSION:

 

On March 1, 2018, as authorized by Government Code, section 31000, Purchasing Agreement No. P-18-263-0, was entered with into with Hanson Bridgett LLP to provide specialized services for legal research, advice and representation related to compliance with ADA and miscellaneous legal services as needed by the County Counsel's Office from March 15, 2019 through February 28, 2019, total compensation not to exceed $50,000. 

 

On February 26, 2019, the Board approved Amendment One to the Purchasing Agreement, thereby creating Agreement No. 19-087 with Hanson Bridgett LLP through December 31, 2020 and increasing the maximum compensation to $250,000.

 

The Department continues to need an outside consultant’s legal expertise for the review of access to County facilities and programs and services.  Approval of the recommended action will allow the County to work with the law firm of Hanson Bridgett to obtain their legal expertise.  The law firm has an extensive history of competency in the area of representation of public agencies as well as providing in-depth legal advice regarding access issues.

 

Department staff is recommending the current agreement be amended a second time to extend the term for one additional year to December 31, 2021.
