RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive First Amendment to Agreement No. A-20-295 with Pinnacle Training Systems, LLC allowing for COVID-19 testing at additional County departments, with no change to the term of July 9, 2020 through December 30, 2020, or compensation maximum of $2,665,600.

REPORT

There is no increase in Net County Cost associated with the recommended action as Coronavirus Aid, Relief, and Economic Security (CARES) Act funds will be utilized to cover the costs associated with the recommended amendment. Due to the COVID-19 pandemic and ongoing spread of COVID-19 in the general County of Fresno population, and a request from your Board to extend testing to Probation staff on August 4, 2020, the recommended amendment will amend language specifying the locations and service options, such as allowing for testing of the household members of the employees, under the above referenced agreement. Approval of the recommended action will allow the County to expedite testing and pay for testing already ordered at Probation’s Juvenile Justice Campus (JJC) and any other locations as needed. Testing services are scheduled to end on December 30, 2020 as the CARES Act currently provides that all claimable costs must be incurred by December 30, 2020. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. Should your Board choose to not approve the recommended action, COVID-19 testing will not occur at Probation JJC or any other County facilities.

 

RETROACTIVE AGREEMENT:

 

Due to urgency of testing at the JJC, Pinnacle Training Systems, LLC (Pinnacle) transitioned to offer testing services at the request of your Board and the Director of Human Resources prior to finalizing the amendment. Additional time needed for processing and the urgency required to start testing prevented this amendment from beginning commensurate with the November 24, 2020 Board date.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action as the costs associated with this emergency contract and the amendment are fully offset with funding from the CARES Act. The billing and per-test rate mechanisms are being changed to reflect the disparity in initially requested tests and actual use. The rate per test is increasing from $140 to $155 per test. An additional fee for not meeting a 25 test per hour testing rate in the amount of $100 per hour per staffer is also included as the initial number of tests sought in the original quote was never reached and the low testing numbers drastically impacted the long-term ability of the vendor to continue to provide services.

 

DISCUSSION:

 

On August 4, 2020, your Board approved Agreement No. A-20-295 with Pinnacle for COVID-19 testing services in the Fresno County Jail. Due to the congregate settings and potential for rapid transmission of the disease, the flexibility to adjust the number of tests ordered and the pricing of the tests was included within the initial contract. However, the ability to add additional testing sites was not included.

 

During the August 4, 2020 Board Meeting, the question of extension of the same services to the Probation Department was broached by your Board and encouragement given to extend those same services to said department. The vendor was contacted and arrangements were made to begin testing in the final weeks of September. The retroactive amendment is necessary to provide purchasing authority for those tests that were not administered on the site stipulated in the initial agreement and to account for the inaccuracy in the initial number of tests sought.

 

Approval of the recommended action provides the County further flexibility in providing testing sites and allows for the testing of the employees and their household members.
