SUBJECT:                     Resolution for Consolidation of the March 2, 2021 Clovis Municipal    Election

 

RECOMMENDED ACTION(S):

TITLE

Adopt a Resolution approving the consolidation of a Special Municipal Election called by the City of Orange Cove with the regularly scheduled March 2, 2021 City of Clovis General Municipal Election and approve the County Clerk/Registrar of Voters to conduct the consolidated election.

REPORT

There is no increase in Net County Cost associated with the recommended action. The City of Orange Cove has called for a Special Municipal Election to be held on March 2, 2021, an established election date for the City of Clovis General Municipal Election. Consolidation of the election will allow the City of Orange Cove to participate in the March 2, 2021 City of Clovis’ regularly scheduled General Municipal Election. The recommended action allows the County Clerk/Registrar of Voters to consolidate both elections and conduct the election on March 2, 2021. This item affects Districts 2, 4 and 5.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved the requesting entity will not be able to participate in and share the costs of the regularly scheduled March 2, 2021 City of Clovis General Municipal Election. Additionally, if the recommended action is not approved, it would be the responsibility of the jurisdictions to conduct their elections. Conducting the City of Orange Cove Special Municipal Election as a non-consolidated separate election would result in a large cost increase for the City of Orange Cove’s called election.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. Estimated expenditures and revenues associated with the consolidated election will be approximately $250,000. The entities have agreed, by Resolution, to reimburse the County for all costs related to the election. Sufficient appropriations and estimated revenues are included within the FY 2020-21 Adopted Budget for the County Clerk/Registrar of Voters Org 2850.

 

DISCUSSION:

 

The Clovis City Council adopted Resolution 20-112 and 20-114, which calls for a General Municipal Election to be held on Tuesday, March 2, 2021 and requests for the Fresno County Board of Supervisors to render specified services to the City of Clovis to conduct the March 2, 2021 General Municipal Election, and authorizes the Clovis City Clerk to work with the Fresno County Clerk/Registrar of Voters to perform any and all activities necessary to conduct the General Municipal Election. Resolution 20-114 also authorizes the City of Clovis to reimburse the County of Fresno in full for the services and material required to conduct the election upon presentation of an election bill to the City of Clovis by the County of Fresno after the election.

 

The City Council of the City of Orange Cove adopted Resolution 2020-36, which called for a Special Municipal Election to be held on Tuesday, March 2, 2021.  Resolution 2020-36 requests the Fresno County Board of Supervisors to render specified services to the City of Orange Cove relating to the conduct of the March 2, 2021 Special Municipal Election, and authorizes the Orange Cove City Clerk to work with the Fresno County Clerk/Registrar of Voters to perform any and all activities necessary to conduct the Special Municipal Election. Resolution 2020-36 authorizes the City of Orange Cove to reimburse the County of Fresno in full for the services and materials required to conduct the election upon presentation of an election bill to the City of Orange Cove by the County of Fresno after the election.  In addition, Resolution 2020-36 requests the March 2, 2021 Special Municipal Election to be consolidated with any election also called to be held on March 2, 2021.

 

In accordance with California Election Code 10002, each request by a jurisdiction to conduct an election is subject to the approval of the Board of Supervisors. Elections Code section 10411 et seq. permits the consolidation of elections.  The Cities of Clovis and Orange Cove will receive an invoice for their pro-rata share of the incurred elections costs in accordance with Elections Code sections 10002 and 10416(c).
