SUBJECT:                     Retroactive Agreement for COVID-19 Testing

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive Agreement with Pinnacle Training Systems, LLC, which replaces Agreement No. A-20-295-1 that terminated on December 30, 2020,  to provide onsite COVID-19 testing services for County employees beginning July 9, 2020 through June 30, 2021 with no change to the compensation maximum of $2,665,600.

REPORT

There is no increase in Net County Cost associated with the recommended action as Coronavirus Aid, Relief, and Economic Security (CARES) Act Coronavirus Relief Fund (CRF) monies will be utilized to cover the costs associated with the recommended amendment. The Consolidated Appropriations Act, 2021, extended the period during which recipients may incur eligible costs that may be covered using payments from the CRF to December 31, 2021 (Division N, Title X, Section 1001). As testing services continue to be needed due to the COVID-19 pandemic and the ongoing spread of COVID-19 in the general County of Fresno population, approval of the recommended action will allow the County to continue testing services as previously agreed through June 30, 2021. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action.  Should your board choose to not approve the recommended action, COVID-19 testing services will be disrupted at County facilities.

 

RETROACTIVE AGREEMENT:

 

Due to the urgency needed for testing at multiple County facilities, Pinnacle Training Systems, LLC (Pinnacle) has continued offering testing services at the request of the Interim Director of Human Resources prior to finalizing the agreement. Uncertainty related to the extension of CARES CRF funding and the urgency necessary to continue COVID-19 testing at County facilities prevented this agreement from beginning commensurate with the January 26, 2021 Board date.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action as the costs associated with this emergency contract and the amendment are fully offset with the funding from the CARES Act CRF. The Consolidated Appropriations Act, 2021, extended the period during which recipients may incur eligible costs that may be covered using payments from the CRF to December 31, 2021 (Division N, Title X, Section 1001). The billing and per-test rate mechanisms, as well as the additional fee for not meeting a 25 test per hour testing rate, will remain the same as they were provided for in Agreement No. A-20-295, as amended by Agreement No. A-20-295-1.  

 

DISCUSSION:

 

On August 4, 2020, your Board approved Agreement A-20-295 with Pinnacle for COVID-19 testing services.

 

On November 24, 2020, a retroactive First Amendment to this Agreement was approved by your Board to provide authority for those tests that were not stipulated in the initial Agreement, to add to the number of tests to be provided at your Board’s direction and to expand testing services to household members of employees and at additional County sites.  Agreement A-20-295, as amended by Agreement No. A-20-295-1, terminated on December 30, 2020.

 

Since the authorization of the First Amendment, which provided the County further flexibility in the testing of County employees and their household members, the availability of CARES Act CRF funding has been extended from the initial end date of December 30, 2020 to December 31, 2021. 

 

Approval of this Service Agreement, which replaces Agreement No. A-20-295 as amended, allows the County to continue uninterrupted testing at multiple County sites through June 30, 2021. There is currently no need to increase the compensation maximum terms of the original agreement.
