SUBJECT: Amendment of Fresno County Ordinance Title 3 (Personnel)
RECOMMENDED ACTION(S):
TITLE
Conduct second hearing and adopt an Ordinance to Amend Title 3 - Personnel of the Fresno County Ordinance to replace existing reference to deleted Ordinance Code 03.08.100 with updated language; and waive the second reading of the Ordinance in its entirety.
REPORT
There is no Net County Cost associated with the recommended actions. Approval of the recommended actions amends Title 3, Section 03.08.130 of the Fresno County Ordinance Code to replace existing references to deleted Ordinance Code 03.08.100 with updated language. This item is countywide.
ALTERNATIVE ACTION(S):
If your Board does not approve the recommended actions, Title 3 of the Fresno County Ordinance Code would remain unchanged.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended actions.
DISCUSSION:
On December 15, 2020, your Board conducted the first hearing to Amend Title 3 - Personnel of the Fresno County Ordinance to replace existing reference to deleted Ordinance Code 03.08.100 with updated language. Staff is now returning to your Board to adopt and waive the second reading of this Ordinance in its entirety.
On April 20, 1954, Section 176 of the Fresno County Ordinance Code established “Removal, Suspension, or Reduction in Rank of Permanent Employee” which was later amended and became Section 03.08.100 of the Fresno County Ordinance Code. Sometime after 1976, Section 03.08.100 was deleted and Personnel Rule 10 “Disciplinary Actions” was adopted in its place.
Currently, Section 03.08.130 “Noncounty employment prohibited” of the Fresno County Ordinance Code provides a reference to deleted Section 03.08.100. Approval of the recommended actions would clean up this administrative oversight by removing said reference and replacing with updated language.
With your Board’s approval, the recommended Ordinance Code changes will take effect 30 days thereafter.
