RECOMMENDED ACTION(S):

TITLE

1.                     Make a finding that it is in the best interest of the County to waive the competitive bidding process consistent with Administrative Policy No. 34 for unusual or extraordinary circumstances for the coordination of child abuse and child neglect prevention efforts as Fresno Child Abuse Prevention Council is the County’s designated child abuse prevention council and Children’s Trust Fund Commission; and, 

 

2.                     Approve and authorize the Chairman to execute a sole source Agreement with Fresno Child Abuse Prevention Council to coordinate child abuse prevention efforts, effective July 1, 2021, not to exceed five consecutive years, which includes a three-year base contract and two optional one-year extensions, total estimated at $907,875.

REPORT

Approval of the recommended actions will provide continued funding to the Fresno Child Abuse Prevention Council also known as Fresno Council on Child Abuse Prevention (FCCAP), the County’s designated child abuse prevention council and Children’s Trust Fund Commission, to coordinate countywide child abuse prevention efforts.  The County is required to fund the child abuse prevention council in accordance with Welfare and Institutions Code (WIC), section (§) 18983.  The recommended agreement will be funded through State Children’s Trust Fund (CTF), Kid’s Plate license fee and birth certificate revenues.  The maximum compensation is estimated and will vary according to actual revenues received, with no increase in Net County Cost.  The item is countywide. 

 

ALTERNATIVE ACTION(S):

 

Should the recommended agreement not be approved, the County will be out of compliance with the legislative requirements outlined in WIC §18983 and will jeopardize federal and state funds received by the County for child abuse prevention services.      

 

SUSPENSION OF COMPETITION/SOLE SOURCE CONTRACT:

 

The Department of Social Services’ request to waive the competitive bidding process consistent with Administrative Policy No. 34 under unusual and extraordinary circumstances is based upon the Board’s prior designation of FCCAP as the County’s only child abuse prevention council and the County’s obligation to fund such a council pursuant to WIC §18960-18983.  The Internal Services Department - Purchasing Division concurs with the Department’s request to waive the competitive bidding process. 



FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions. The total cost of the agreement will be offset by birth certificate fees and Kid’s Plate license fee revenues deposited in the County’s CTF.  All monies collected by the Department will be disbursed to FCCAP.  Funds received for birth certificate fees and Kid’s Plate revenues for FY 2019-20 were $152,315 and estimated receipts for FY2021-22 are $181,575. The total estimated for the five-year term is $907,875. Sufficient appropriations are included in the Department’s Org 5610 FY 2021-22 Recommended Budget and will be included in subsequent applicable fiscal years.

 

DISCUSSION:

 

On August 23, 2005, the Board designated FCCAP as the County’s child abuse prevention council.  Pursuant to WIC §18960-18983, this body’s primary purpose is to coordinate the community’s efforts to prevent and promote awareness around child abuse.  The legislation further mandates that counties fund the child abuse prevention council from the CTF. Approval of the recommended actions are necessary to support continued efforts to prevent child abuse and provide training to the community on the impact of child abuse.

 

As required by WIC §18982.2, FCCAP’s functions include providing a forum for interagency cooperation in the prevention, detection, treatment, and legal processing of child abuse cases; promoting public awareness of abuse/neglect; facilitating training of professionals in child abuse/neglect; recommending improvements in services; and facilitating community support for child abuse and neglect programs. 

 

Services provided by FCCAP include child abuse prevention presentations, mandated reporter training, Child Abuse Prevention Month events, coordination of interagency roundtables, and distribution of child abuse prevention resources. In FY 2019-20, FCCAP trained over 2,000 professionals in mandated reporter requirements and a combined total of 140 adults in child abuse, stewardship, and alternative discipline.  

 

If approved, the recommended agreement will be effective from July 1, 2021 through June 30, 2024 and may be extended for two additional twelve month periods based upon satisfactory performance with a written notice by the Department Director, or designee, and FCCAP.
