SUBJECT: Agreement with Biola Community Services District for Active Transportation Project No. ATPL-5942(303), Biola Community Sidewalks
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute an Agreement with the Biola Community Services District for the Biola Community Sidewalks Project, Active Transportation Project No. ATPL-5942(303), providing for assumption by Biola Community Services District of responsibility and liability for operation and maintenance liability of the project improvements following the completion of Construction.
REPORT
Approval of the recommended action will authorize execution of an Agreement between the County and the Biola Community Services District (BCSD) obtaining BCSD’s commitment for the necessary maintenance of pedestrian improvements as well as storm drainage system upon completion of the Active Transportation Project (ATP), Federal No. ATPL-5942 (303) (Project), Biola Community Sidewalks. This item pertains to a location in District 1.
ALTERNATIVE ACTION(S):
Your Board may reject the recommended action; however, rejecting the recommended action may impact the County’s ability to hold BCSD liable for maintaining the Project improvements in perpetuity upon completion of the Project.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended action. The Project’s total estimated cost is $1,498,000, which includes administration, design, environmental and construction of the Project and will be covered with ATP funding secured by the Department. ATP funds in the amount of $245,000 are included in the Department of Public Works and Planning FY 2020-21 Adopted Budget, and ATP funds in the amount of $1,255,000 are included in the Department’s FY 2021-22 Adopted Budget. The funds are provided on a reimbursement basis by Caltrans.
DISCUSSION:
The Project consists of widening the road, construction of sidewalks, curb & gutter, ADA curb ramps, and drainage facilities on the east side of Biola Avenue from Shaw Avenue to the Alley between F and G St; and on the north side of C Street from Biola Avenue to the Biola Community Center. The project also includes the installation of flashing crosswalk signs on either side of Biola Avenue at the intersections of C Street and D Street near Biola-Pershing Elementary School. The Project will benefit the residents of the unincorporated community of Biola by providing improved pedestrian safety for all residents, including children and disabled persons. The Project is expected to be completed by September 30, 2024.
In a letter dated September 17, 2020 (Attachment A to the Agreement), the District made a commitment to maintain the Project improvements in perpetuity after completion of the construction. The Agreement on the agenda today reconfirms and details the conditions of that commitment. With your Board’s approval, the Agreement between the County and BCSD regarding this the Project will become effective upon execution.
OTHER REVIEWING AGENCIES:
The Biola Community Services District has reviewed and approved the recommended agreement on September 16, 2021.
