SUBJECT:                     Temporary Entry Permit with California Department of Water Resources

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Director of Internal Services/Chief Information Officer to execute a Temporary Entry Permit (APN 045-061-05ST) with the California Department of Water Resources, effective upon receipt of the fully executed permit, not to exceed three consecutive years, which includes an initial term expiring December 31, 2022, and automatic one-year extensions.

REPORT

Approval of the recommended action will allow the California Department of Water Resources (DWR) access to a portion of county-owned property located at W Elkhorn Ave and S San Mateo Ave (APN 045-061-05ST), to inspect and maintain an irrigation line that crosses the California Aqueduct as part of the California Aqueduct Subsidence Program’s, Embankment and Liner Raise Projects, see Attachment A. The item pertains to a location in District 1.

 

ALTERNATIVE ACTION(S):

 

Your Board could choose not to approve the Temporary Entry Permit; however, DWR would not be able to work on items in the County’s right-of-way as part of the California Aqueduct Subsidence Program.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action.

 

DISCUSSION:

 

DWR is requesting temporary access to county-owned property, identified as APN 045-061-05ST, for the purpose of maintenance and inspection of an irrigation line that runs through the California Aqueduct as part of the California Aqueduct Subsidence Program’s, Embankment and Liner Raise Projects. A portion of the property is used for the Wastewater Treatment Facility for County Service Area 32 - Cantua Creek. Adjacent to the property, approximately 20 acres are being leased for agricultural use.

 

These DWR projects aim to raise the embankments, concrete liner, and structures in Pools 17, 18, 20, and 21 to regain lost flow capacity to design levels to address reduced flow capacity in the California Aqueduct throughout the Central Valley that limits the ability to deliver water to Southern California.

 

The recommended Temporary Access Permit will allow DWR’s officers, employees, agents, and persons under contract to enter the property with the necessary equipment to perform the following tasks, with respect to the inspection and maintenance of the irrigation line:

 

                     Conduct environmental, cultural, and geodetic surveys,

                     Excavate and inspect the irrigation line,

                     Perform routine maintenance on the irrigation line, and

                     Perform any other incidental tasks as may be required for the Pools 17 & 18 and Pools 20 & 21 Embankment and Liner Raise Projects currently being undertaken by the California Aqueduct Subsidence Program.

 

The recommended Temporary Entry Permit will be effective upon County’s receipt of the fully executed permit and expire on December 31, 2022. Following that, it will automatically renew for one-year periods unless written notice is provided 60 days prior to the expiration of the permit by either party.

 

Based on this information, Internal Services Department staff recommends the execution of the recommended Temporary Entry Permit to grant the DWR access to the property. The Department of Public Works and Planning was consulted and concurs with the recommended action.
