SUBJECT:                     Award Contract 21-S-01, Fresno County Sheriff Substation Bid Package 2

 

RECOMMENDED ACTION(S):

TITLE

1.                     Adopt Plans and Specifications for Contract 21-S-01 Fresno County Sheriff Substation Bid Package 2, and award to the low bidder, BMY Construction Group, Inc., 2485 East Olive Avenue, Fresno CA 93727, including the base bid and all the additive bids, in the total amount of $2,465,000; and

 

2.                     Authorize the Chairman to execute Contract Change Orders in excess of the Director’s authority, up to 10% of the construction contract total, in the amount of $246,500, increasing the contract maximum to $2,711,500.

REPORT

Approval of the recommended actions will authorize the construction of Phase 2 of the Area 2 Sheriff Substation project.  This item pertains to a location in District 5, the impact of which will be countywide.

 

ALTERNATIVE ACTION(S):

 

If the first recommended action is not approved, construction of Phase 2 will be delayed.  If the second recommended action is not approved, or approved for a lesser amount, the Department may return to your Board for approval of individual change orders, which could result in project delays.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action.  It is anticipated that the contract construction cost for the project will not exceed $2,711,500.  This includes the Director’s allowance to sign Change Orders up to $135,750 (approximately 5.5% of the contract amount) while the Chairman will have authority, if that amount is exceeded, to sign subsequent change orders up to $246,500 (between 5.5% and 10% of the contract amount). Sufficient funds to cover the cost of construction are included in the Public Works and Planning Capital Projects Org 8853 Program 91285 FY 2021-22 Adopted Budget.

 

DISCUSSION:

 

The Sheriff’s Office is responsible for the apprehension of criminal suspects for crimes committed in the unincorporated areas of Fresno County.  This includes investigation, gathering documentation, preservation, analysis, and court testimony for evidence seized.  The Department is also responsible for providing these services in the rural areas of the County and oversees area substations to provide such services.  Area 2 is comprised of the unincorporated portions of metropolitan Fresno County and serves several communities within the boundaries of American Avenue to the Madera County line and Chateau Fresno to McCall Avenue including Calwa, Malaga, Mayfair, Sunnyside, Fig Garden and Tarpey.

 

On October 9, 2018, the Board approved the purchase of land located at the Southwest corner of Harvey and Armstrong Avenues to construct the new Area 2 substation and parking lot.  On July 7, 2020, the Board approved the award of construction of the new substation to Klassen Corporation in the amount of $11,364,500.  The new construction consisted of the construction of a new Sheriff Substation, a Vehicle and Evidence Storage building, parking lot and associated site improvements.  The project consists of steel-framed, single-story buildings of approximately 22,700 square feet for the Sheriff Substation and 35,520 square feet for the Vehicle and Evidence Storage building on a site of approximately 6.5 acres. Construction began September 2020 and is still ongoing.

 

The original bid package did not include the plans for the planned data center to be located within the storage building because it had not been fully designed when the rest of the project was ready to advertise.  In addition, other modifications and improvements to the scope were desired beyond the scope of the original project.  The work for Bid Package 2 consists of construction of a new data center located within the existing storage building, expansion of the existing electrical room located in the existing substation building, concrete slabs, concrete pads, interior light gauge metal framing, and storefront glass.  The installation of carport canopies and installation of EV Charging Stations are included as additive bids. (The EV charging stations will be provided by the County funded through a Charge Up! grant from the San Joaquin Valley Air Pollution Control District approved by your Board on March 22, 2022). 

 

Authority for the Chairman to sign change orders up to 10% of the contract amount is requested in order to ensure any change orders needed to complete the project’s scope are completed in a timely manner.  Due to unprecedented challenges in the material supply chain, there is a potential for the contractor to submit claims for increased costs.  Any such claims would have to be assessed and weighed in order to prove they were due to extenuating circumstances beyond the control of the contractor.  Any change orders above the Director’s authority will be provided to the Chairman for review and signature.

 

The Department issued the Notice to Bidders for this project on February 15, 2022.  A bid opening was held on April 14, 2022 and three bids were received.  The low bid from BMY Construction Group was $2,465,000 or 28.63%, below the architect’s estimate of $3,453,890. The bidders and their respective bid amounts are shown below:
