SUBJECT: Permission for Assessor-Recorder to absent himself from the State for
more than 30 days but not to exceed two months.

RECOMMENDED ACTION(S):
TITLE
Grant permission for Assessor-Recorder to absent himself from the State for 30 days, but not more than two months, in accordance with Government Code Section 1063.
REPORT
ALTERNATIVE ACTION(S):

If the recommended action is not approved, the Assessor-Recorder will not have permission to absent himself from the State for more than 30 days.

FISCAL IMPACT:

There is no fiscal impact associated with the recommended action.

DISCUSSION:

Assessor-Recorder Paul Dictos will be out of State for a personal trip for two weeks. Government Code Section 1063 provides that "No officer of a county or judicial district shall absent himself from the state for more than 30 days unless either: (a) Upon business for the state, county or judicial district, (b) With the consent of the board of supervisors of the county."

Section 1063 further provides that such officer must not absent himself from the State for more than two months without the consent of the Board of Supervisors, with the written approval of the Governor, and the absence must not continue for a period exceeding six months in any one year.

Additionally, Government Code Section 1770 provides that "An office becomes vacant on the happening of any of the following events before the expiration of the term: (f) His or her absence from the state without the permission required by law beyond the period allowed by law."

The out of state trip in question is currently scheduled for two weeks. Out of an abundance of caution, the Assessor-Recorder requests Board approval to be absent from the State for more than 30 days, but not more than two months, so that he does not exceed the limit set by Government Code Section 1063.
